A Scottish sheriff has ruled that a suspected director of a campervan rental company maintained operational control while a medical assessment had declared him unfit to participate in legal proceedings. The judge determined that the defendant breached statutory obligations by providing false information about his capacity to appear in court.
The individual, previously acting as an advisor to the firm, is alleged to have continued making managerial decisions during the period his fitness was formally questioned. The court highlighted that persisting in such a role under those circumstances contravenes the law.
During the hearing, it was also established that the defendant gave misleading statements regarding personal circumstances in order to circumvent judicial requirements. The presiding sheriff emphasized that such deception undermines confidence in both the justice system and commercial governance.
The ruling includes an order that the company be placed under the supervision of an independent administrator until the defendant's legal unfitness is definitively resolved. Additionally, a fine was imposed, though the specific amount was not disclosed in the judgment.
